1. Access and account

To use the Services, including browsing our online stores or purchasing products or services, you may be asked to provide information such as your email address and billing, payment and shipping details. You represent and warrant that the information you provide is accurate, current and complete, and that you have the necessary rights to provide it. You are solely responsible for keeping your account credentials secure and for all activity on your account. You may not transfer, sell, assign or license your account to anyone else.

2. Our products

We have made every effort to represent our products and services accurately in our online stores. Colours and appearance may differ on your screen depending on your device, settings and configuration. We do not guarantee that the appearance or quality of products or services you purchase will meet your expectations or match exactly what is described or displayed. Product descriptions may change at any time without notice at our sole discretion. We may discontinue any product at any time and limit quantities offered to any person, geographical region or jurisdiction on a case-by-case basis.

3. Orders

When you place an order, you offer to purchase and authorise us and our payment providers to charge your selected payment method for the order total. niklashallberg may accept or decline your order for any reason at its sole discretion, subject to applicable law. Your order is not accepted until niklashallberg confirms it. We must receive and process payment before accepting your order. Please review your order carefully before submitting it, as we may not be able to accommodate cancellation requests after acceptance. If we decline, change or cancel an order, we may attempt to notify you using the email address, billing address and/or phone number provided when ordering. Purchases may only be returned or exchanged in accordance with our Return and Refund Policy, without limiting your rights under applicable law. You represent and warrant that purchases are for personal or household use, not commercial resale or export.

4. Pricing and billing

Prices, discounts and promotions may change without notice. The price charged is the price in effect when the order is placed, as stated in your email confirmation. Unless expressly stated otherwise, listed prices exclude taxes, shipping, handling, customs duties and import charges. Online prices may differ from prices in physical stores or third-party stores. Promotions may have separate terms; if they conflict with these terms, the promotion terms apply.

You agree to provide current, complete and accurate purchase, payment and account information and promptly update it, including your email address, credit card numbers and expiry dates, so we can complete transactions and contact you as needed. You represent and warrant that you are authorised to use the payment method provided; its information is true, accurate and complete; your payment provider will honour the charges; and you will pay the charges incurred at the listed prices, including shipping, handling and applicable taxes.

5. Shipping and delivery

Unless otherwise stated, we are not responsible for shipping or delivery delays. Delivery times are estimates, not guarantees. We are not responsible for delays caused by carriers, customs processing or events outside our control. To the extent permitted by applicable law, title and risk of loss pass to you when we hand products to the carrier, unless applicable law provides otherwise. We are not responsible for delays or failures caused by events beyond our reasonable control, including carrier or customs delays, natural disasters, extreme weather, labour disputes, supply shortages, power or telecommunications outages, cyber incidents, government action or similar events. Product listings are likewise managed and owned by niklashallberg. Such rights remain exclusively with niklashallberg or the original rights holder.

These terms permit personal, non-commercial use of the Services only. You may not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store or transmit material from the Services without our prior written consent. Except as expressly stated, these terms grant no licence or other rights to intellectual property belonging to niklashallberg, Shopify or any third party. The niklashallberg name, logos, product and service names, designs and slogans are trademarks of niklashallberg, its affiliates or licensors and may not be used without prior written permission. Shopify's name, logo, product and service names, designs and slogans are Shopify trademarks. All other such names and marks belong to their respective owners.

7. Optional tools

The Services may provide access to third-party customer tools that we do not monitor, control or contribute to. You acknowledge that access is provided “as is” and “as available”, without warranties, representations or conditions of any kind and without endorsement. We have no liability arising from your use of optional third-party tools. Use is entirely at your own risk and discretion, and you should understand and approve the relevant provider's terms. Future features, including new tools and resources, will also form part of the Services and be subject to these terms.

The Services may include materials and links to third-party websites, including embedded functionality. We are not responsible for examining or evaluating their content or accuracy. Accessing third-party materials or websites is at your own risk. We are not responsible for harm or damages connected with accessing third-party websites or purchasing or using their products, services, resources or content. 9. Relationship with Shopify

niklashallberg is powered by Shopify. Your device communicates with Shopify's systems to deliver the Services; section 10 explains how Shopify uses and processes information from these interactions. All purchases and sales in this store are directly with niklashallberg. You acknowledge and agree that Shopify is not responsible for any aspect of sales between you and niklashallberg, including injury, damage or loss resulting from purchased products and services. You expressly release Shopify and its affiliates from claims, damages and liabilities arising from or relating to your purchases and transactions with niklashallberg.

10. Privacy Policy

Our Privacy Policy explains how we may collect, use and share personal information through your use of the Services. By using the Services, you acknowledge that you have read it. We have no obligation to keep Feedback confidential, compensate you or respond. We may, but need not, monitor, edit or remove Feedback we consider unlawful, offensive, threatening, abusive, defamatory, pornographic, obscene, otherwise objectionable or in violation of intellectual property rights or these terms.

You agree that Feedback will not violate third-party rights, including copyright, trademark, privacy, personality or other personal or proprietary rights, or contain unlawful, defamatory, abusive or obscene material, viruses or other malware affecting the Services or related websites. We may terminate this agreement or your access to any part of the Services at any time at our sole discretion without notice. You remain liable for amounts due up to and including the termination date. The following sections survive termination: Intellectual property, Feedback, Termination, Disclaimer of warranties, Limitation of liability, Indemnification, Severability, Waiver; entire agreement, Assignment, Governing law, Privacy Policy, and any provisions that by their nature should survive.

WE DO NOT GUARANTEE, REPRESENT OR WARRANT THAT USE OF THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE. 17. Limitation of liability

TO THE EXTENT PERMITTED BY LAW, IN NO EVENT SHALL niklashallberg, OUR PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS OR LICENSORS, OR THOSE OF SHOPIFY AND ITS AFFILIATES, BE LIABLE FOR INJURY, LOSS, CLAIM OR DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING LOST PROFITS, REVENUE, SAVINGS, DATA, REPLACEMENT COSTS OR SIMILAR DAMAGES, WHETHER BASED ON CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, ARISING FROM USE OF THE SERVICES OR PRODUCTS PURCHASED THROUGH THEM, OR ANY CLAIM RELATED TO USE OF THE SERVICES OR A PRODUCT, INCLUDING CONTENT ERRORS OR OMISSIONS OR LOSS OR DAMAGE RESULTING FROM USE OF THE SERVICES OR CONTENT OR PRODUCTS POSTED, TRANSMITTED OR OTHERWISE MADE AVAILABLE THROUGH THEM, EVEN IF ADVISED OF THE POSSIBILITY. 18. Indemnification

You agree to indemnify, defend and hold harmless niklashallberg, Shopify and our affiliates, partners, officers, directors, employees, agents, contractors, licensors and service providers from losses, damages, liabilities or claims, including reasonable legal fees, payable to third parties arising from or relating to your breach of these terms or incorporated documents, your violation of law or third-party rights, or your access to and use of the Services. We will notify you of indemnifiable claims; failure to notify promptly does not release your obligations unless you are materially prejudiced. We may control defence and settlement at your expense, including choice of counsel, but will not settle claims requiring non-monetary obligations from you without your consent, which must not be unreasonably withheld. You will cooperate in the defence, including providing relevant documents.

19. Severability

If a provision is found unlawful, void or unenforceable, it remains enforceable to the extent permitted by applicable law and the unenforceable part is severed, without affecting the validity and enforceability of the remaining provisions. Nothing limits rights under consumer protection or other laws that cannot be waived. If any part conflicts with those rights, those rights prevail.

20. Waiver; entire agreement

Failure to exercise or enforce a right or provision is not a waiver. These terms and policies or operating rules published on this website or concerning the Services constitute the entire agreement between you and us and govern your use of the Services. They supersede prior or contemporaneous agreements, communications and proposals, oral or written, including previous versions of these terms. Ambiguities in interpretation shall not be construed against the drafting party.

21. Assignment

You may not delegate, transfer or assign this agreement or your rights or obligations without our prior written consent; attempts to do so are void. We may transfer, assign or delegate these terms and our rights and obligations without your consent or notice.

22. Governing law

These terms are governed by the laws of the jurisdiction where niklashallberg is headquartered or registered, without regard to conflict-of-law principles. You and niklashallberg agree to jurisdiction and venue in the courts located there, except where prohibited by applicable law, and consent to those courts' personal jurisdiction. Nothing limits rights to bring claims in your local courts or rely on mandatory laws where you live.

23. Translations

These terms may be available in languages other than English. In case of inconsistencies or conflicts between these English terms and other language versions, the latest English version prevails. Disputes arising from these terms will be resolved in English unless niklashallberg decides otherwise at its sole discretion or applicable law requires otherwise.

Headings are for convenience only and do not limit or otherwise affect these terms.

25. Electronic communications

By using the Services or placing an order, you consent to transactional and service-related electronic messages, including emails, account messages and posts in the Services.
